Four Chinese nationals who were arrested after one of them was captured on video caning a Kenyan at a Kileleshwa restaurant will remain in custody for three more days pending a ruling on their bail application.
The four were arraigned at the Milimani Law Courts on Monday, with the prosecution seeking 21 days to detain them as investigations continue.
The defense strongly opposed the application for 21 days arguing that the charges against the accused were not strong enough to warrant such a long investigation period.
“The charges are not serious to warrant 21 days… The prosecution doesn’t need the 21 days to investigate,”
The video shared on social media has generated public interest but we must not loose sight, there are always two sides of a story and the video doesn’t give us the context,” the court was told.
The court will rule on whether to grant the prosecution’s request on Thursday.
The four include Deng Hailan, who was captured assaulting the employee, Chang Yueping and Ou Qiang, who were arrested for reportedly holding expired Visas.
A fourth suspect, Yu Ling, a cashier, was arrested for holding a visitor’s Visa but without a work permit.
They are facing charges of assault and causing actual bodily harm
